These terms cover your use of Am I Drunk?, an iOS, iPadOS, and watchOS application produced by Halley Software, based in Portugal. By downloading, installing, or using the app you agree to these terms.

Am I Drunk? is for entertainment and informational purposes only. It is not a medical device, a breathalyzer, or a measure of your fitness to drive. It never indicates that it is safe or legal to drive at any reading — including 0.00. If you've had any alcohol, don't drive.
1. What Am I Drunk? is
Am I Drunk? is an iPhone, iPad, and Apple Watch app that estimates blood alcohol content (BAC) for entertainment and informational purposes. Estimates are calculated on your device using the Widmark formula from the profile and drinks you enter. The app runs on-device and works offline on the free tier.
2. Eligibility and acceptable use
Am I Drunk? is intended for adults of legal drinking age in their jurisdiction. You agree not to:
- Reverse-engineer, decompile, or disassemble the app, except as permitted by Portuguese or EU law
- Attempt to bypass the in-app purchase or unlock paid features by illegitimate means
- Rely on the app to decide whether to drive, operate machinery, or take any other safety-, medical-, or legal-related action
3. Not a safety device — no reliance
The app's BAC figures are estimates only. They are approximations produced by a mathematical model and are affected by many factors the app cannot measure (food, medication, health, individual metabolism, measurement error, and more). They can be wrong in either direction. Do not rely on them to decide whether it is safe or legal to drive, or to do anything else. The only safe message about drinking and driving is: if you've had any alcohol, don't drive.
4. Am I Drunk? Pro — one-time purchase
Am I Drunk? Pro is an optional one-time, non-consumable in-app purchase that unlocks syncing your session history and profile across your devices through your own private iCloud.
- Price: €2.99 (regional pricing may differ; the price shown in the App Store at purchase is authoritative)
- It is not a subscription — there is no recurring charge, no auto-renewal, and no free trial.
- Because it is non-consumable, you can restore it at no extra cost on any device signed in with the same Apple ID, using "Restore Purchases" in the app.
5. Payments and refunds
All payments are processed by Apple through the App Store. Halley Software does not see your payment method, full name, Apple ID, or any financial information — we receive only a signed receipt from Apple confirming the purchase.
Refund requests go through Apple: https://support.apple.com/HT204084. Refund eligibility is governed by Apple's terms, not by Halley Software.
6. Intellectual property
Am I Drunk? — its code, design, and original content — is owned by Halley Software.
7. Termination
You may stop using Am I Drunk? at any time by deleting the app. A one-time Am I Drunk? Pro purchase remains tied to your Apple ID and can be restored later. Halley Software may terminate or suspend access for abuse or violations of these terms, with reasonable notice where practicable.
8. Disclaimer and limitation of liability
Am I Drunk? is provided "as is" without warranty of any kind, to the maximum extent permitted by applicable law. The app does not measure blood alcohol; it estimates it for entertainment and informational purposes, and Halley Software makes no warranty as to the accuracy of any estimate. To the maximum extent permitted by law, Halley Software is not liable for any decision made, or action taken, in reliance on the app — including any decision to drive. To the extent allowed by law, Halley Software's total liability arising from your use of Am I Drunk? is limited to the amount you paid for the app (the one-time purchase price, if any).
This does not limit liability that cannot be excluded under Portuguese or EU consumer law (e.g., statutory rights of consumers).
9. Governing law, changes, and contact
These terms are governed by the laws of Portugal. Disputes fall under the competent courts of Portugal, without prejudice to any protective rights you may have under the consumer law of your country of residence.
App Store purchases are additionally governed by Apple's standard Licensed Application End User License Agreement: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
Changes to these terms will be reflected by updating the "Last updated" date above and, for material changes, a short notice on this page.
